Which labour laws apply to my business in Kerala?
In Kerala, businesses must comply with EPF Act (20+ employees), ESI Act (10+ employees, wages ≤₹21,000), Professional Tax (all states have PT obligations), Labour Welfare Fund, Shops & Establishments Act (Kerala Shops Act), Contract Labour Act (if using contract workers), Maternity Benefit Act, and the POSH Act. The specific acts depend on your industry, employee count, and business type. Our team conducts a compliance mapping exercise to identify exactly which laws apply to you.
What are the penalties for non-compliance with PF/ESI?
For EPF, employers face a penalty of 5% per annum for delayed contributions, plus damages up to 25% of arrears. ESI non-compliance can attract imprisonment up to 2 years and/or a fine of ₹5,000. More critically, both carry interest on delayed payments and can result in prosecution. Proactive compliance is always far cheaper than penalties.
What are the new Labour Codes and how do they affect my business?
The Government of India has consolidated 29 central labour laws into 4 Labour Codes: the Code on Wages, Code on Industrial Relations, Code on Social Security, and Code on Occupational Safety. Once implemented, these will change definitions of wages, EPF/ESI applicability, working hour norms, and more. We help businesses assess their readiness and prepare for the transition.
Do I need to register for ESI if I have fewer than 10 employees?
The ESI Act applies to establishments with 10 or more employees (in some states, 20+). If you have fewer than 10 employees, ESI registration is not mandatory. However, if you cross this threshold at any point, registration must be done within 15 days. We help you track and manage this transition proactively.
